I’ve done some research across the Internet and gathered a list of Pros and Cons regarding the “Cash For Clunkers” program. Buying a Property in Romania – Real Estate Law in Romania

If you are looking to buy a holiday or second home or invest in Romania, Transylvania or at the Black Sea and you are a foreign citizen/investor, there are few aspects you should know about the procedure an the costs for the acquisition of Romanian land or Romanian houses.

Under Romanian law there are three basic rights to land and buildings such as right of ownership; usage rights as lease, usufruct, superficies; concession right. The principle of contractual liberty represents the key core of the property law in Romania.

Sometimes, an investor/purchaser can opt for closing a pre-sale agreement, by which the seller undertakes to transfer ownership to the buyer at a certain date in exchange for an agreed consideration. The content of the pre-sale contract will stipulate all commercial and legal conditions for the transfer of ownership, as conditions precedent to the final transfer of ownership. The closing of such pre-contract for purchase does not means the transfer over the property, but the stipulate binding obligations for the parties, in regard to, as example, damages or penalties set out in them, if the seller refuses to sign the final notarized deed of transfer at the agreed deadline.

The closing of the pre-sale agreement is to protect the investor/buyer from any possible purchase to other buyers and to matters regarding the fixed price and duration of a future purchase. In our point of view, it is a must that the pre-sale agreement to be concluded at a Public Notary and clearly stipulate the sale price and other clauses regarding duration of future purchase. In this case, it can be enforced in court on the buyer’s request as a deed to transfer ownership.

Winning at Texas Hold'em – Is Knowing the Odds of Any Value?

You've read the books and articles where the poker reporters state the odds of making certain hands. For example: making an open end (outside) straight draw is 5 to 1, a flush draw is 4.2 to 1, and a gutshot (inside) straight draw is 11 to 1. Playing Texas Hold'em there are many variations in the odds to be learned such as what's the difference in the odds if the next card is the turn (4th card) or the river (5th card)?

But let's look at the logic and math behind these calculations to determine if they are of any value to us as poker players. How are the odds of 5 to 1 calculated for an open end straight draw? To successfully complete the straight we need one of eight cards, four on either end of our four-card straight. How many cards remain unseen? We started with 52, 8 of them are useful to us and we see four of them in our partially completed straight. So, the experts say 52 minus 8 minus 4 leaves us with 40 unseen cards, which are of no value to us. Therefore 40 failures to 8 successes works out to 5 to 1 odds. And I say GARBAGE. Your actual odds could be much higher or much lower.

Let's say you're playing in a ring game with ten at the table. That means that twenty cards have been dealt plus three for the flop and one has been "burned" by the dealer. If all of the eight cards you need to complete a straight have already been dealt to other players, your chances of making your straight are ZERO, and your odds according to mathematicians are infinite. On the other hand, what happens if all of your eight cards remain in the pack the dealer is holding? The dealer holds 52 less 20 dilet to the players less 3 for the flop less 1 burned or 28 cards. So now calculate your odds: 20 cards that will not help and 8 cards that will, which works out to 2.5 to 1. Quite a difference!

Instead of flatly assuming that our odds of completing an outside straight are 5 to 1, we gamblers should think that our odds are between 2.5 to 1 and infinity, or just plain unknown. So in my opinion it's of little use to spend a lot of time learning the odds of making straights, flushes, sets, or quads.

So what's a poker player to do, aside from praying for a lot of luck? One answer is to realize that making some hands will be more difficult than others. Obviously it's harder to make a gutshoot straight than an open ended straight. If we're going out on a limit to make a long-odd hand, we better be well rewarded if we make it. If there's not a lot of money in the pot, think twice about paying to draw to an inside straight.

Notice this analysis changes with head to head competition since fewer cards will be eliminated to other players.

3. By user- Facebook is a social networking site used exclusively by college students. Facebook is too cool for MySpace and serves a smaller, more sophisticated cohort. Only college students may participate with their campus e-mail IDs.

4. By product or service class- Margarine competes as an alternative to butter. Margarine is positioned as a lower cost and healthier alternative to butter, while butter provides better taste and wholesome ingredients.

5. By competitor- BMW and Mercedes often compare themselves to each other segmenting the market to just the crème de la crème of the automobile market. Ford and Chevy need not apply.

6. By price or quality- Tiffany and Costco both sell diamonds. Tiffany wants us to believe that their diamonds are of the highest quality, while Costco tells us that diamonds are diamonds and that only a chump will pay Tiffany prices.

Positioning is what the customer believes and not what the provider wants them to believe. Positioning can change due the counter measures taken at the competition. Managing your product positioning requires that you know your customer and that you understand your competition; generally, this is the job of market research not just what the enterpreneur thinks is true.

If you are thinking of purchasing a gun, or other “self-protection” device such as pepper spray or an alarm, then you are obviously concerned about your personal safety. Stripped of its technical terms, outsourcing is basically the practice of one company to contract another company to provide the services that could have been performed by their own staff. There are many reasons why companies now are on the bandwagon of having some of their services done by others. (It had been an old practice, really.) These outsourced services passed on to other companies are usually call center services, e-mail services, and payroll. These particular jobs are part of the outsourcing trend practiced by many companies these days.

Reasons

One of the main reasons why companies are into outsourcing is diminished company resources, both in financial terms and in manpower costs. When a company expands (which can be sudden), the growth can start to eat up on the companies resources.

Financially, the company might not be able to match the growth with the needed infusion of money to sustain the expansion. This holds true with their human resources as well.

With the growth, manpower might be sucked up with the new growth and diminish the company’s productivity in its core areas. The service-providing companies can do the work for less costs (thus not over-stretching most of the company’s resources), and has the manpower to do it.

Other Reasons

Efficiency sometimes suffers once there is a sudden expansion that cannot be absorbed by the company’s present staff setup and other resources. If, for instance, there is a huge demand for huge number of their products, other departments might not be up to it.

The purchasing department might need so many men to do the buying of raw materials, for instance. Outsourcing the purchasing department is a good move and costs less.

The biggest argument against this deal is actually focused on the relationship of the company and its clients. In short, it may invite dissatisfaction from client side. Reasons could range from lower quality of work output, unnecessary dilution of company-client trade secrets, etc.

Control

Control is also put to the test. Some aspects of the company are in danger of spinning out of the company’s control since the outsourced company conducts the decisions that would have been better handled by the parent company.

Some clients are not fully convinced that the outsourced company can function as efficiently as the original contracted company. If they do (most companies can, in practice), clients feel it might be better to deal with the new company rather than their old supplier or contracted business partner.

Riding on this threat is the mounting danger of delayed communications that causes delayed implementation. Without proper management and apportioning of responsibilities, there is tendency that confusion might set in.

Many people shop at swap meets to save money and get good deals, and cold winter days do not stop them.

Many people begin shopping more at indoor flea markets because they like the warmth, but the hardcore flea market shopper will still hit the outdoor flea markets even when it is snowing, because they know that since many people wimped out and went indoors, that leaves all the bargains for them. Sellers will still offer the usual swap meet fare, the used stuff and the new stuff, but no matter the time of year successful flea market vendors will still follow the rules: always sell what people want and need.
